Job Reference * JR00118722 Job Summary * Lead - Legal/Senior Lead - Legal Job Purpose "This position is open with Bajaj finance limited" This job role is essential to (a) handle and monitor all types of litigations; (b) mitigate the legal and reputation risk by advising cross function teams with a perspective to prevent anticipated litigations; (c) formulate appropriate litigation strategy, considering the nature and facts of sensitive cases; (d) to mitigate/ minimise the risk that may arise out of the existing litigation ; and (e) prepare litigation report for presentation before Board as well as submission with regulators. • Matters to be handled before various Courts/Commission/Tribunals: (a) Civil proceedings before courts [ before Munisf Courts, Sub-ordinate courts, District Courts, High Courts, Supreme Court of India]. (b) Criminal Courts [ before Magistrate Court, Sessions & District Courts, Appellate Courts, High Courts & Supreme Court of India]. (c) Labour Courts [ dealing with Employment law related matters ]. (d) Consumer Commission [ District Consumer Commission, State Consumer Disputes Redressal Commission, National Consumer Disputes Redressal Commission ]. (e) Tribunals [ National Company Law Tribunal, National Company Law Appellate Tribunal, Industrial Disputes Tribunal etc.]. (f) ICANN in connection with “.com” and other domains of international origin. (g) NIXI in connection with “.in” domains within India. (h) Trade mark registry & Appellate Authority in connection with Trade mark registration, opposing of application for similar trade marks by third parties and defending/prosecuting litigation pertaining to copy right/trade mark infringement. (i) Social media issues to be taken up with Grievance Redressal officer, escalate to the relevant Ministries of Government on a case to case basis • Types of Litigation (i) Key Litigation: Litigation by Customers/third party against company/ Directors / Promoters/ SMT; 2 Litigation against Company: 3Litigation initiated by Company Job Duties & Key Responsibilities * Duties and Responsibilities - PRINCIPAL ACCOUNTABILITIES (Accountabilities associated with the job) Monitoring: • To deal with various notices from lawyers/Statutory/Judicial/ Quasi Judicial authorities. • To prevent/ minimize litigation. • To strategise in matters which have taken the shape of litigation and mitigate / minimize the risk against Company. • IPR (TM & Domain) related matters which includes (a) filing opposition/objections with TM Registry against deceptively similar TMs; (b) Registration of TMs; (c) Copyright registration as per business requirement; (d) initiation of appropriate legal actions against infringement of IPR; • Issuance and cancellation of PoA & LoA in favor of officers of BFL. • QIP related work; • Ensure accuracy in maintaining and reporting all types of l MIS of all litigations and cost; • To provide data for RBI inspection internal & external Audit and submission before the Board. • Empanelment of Advocates & Law Firms. Provide Legal support to : • RCU team in lodging complaints related to fraud cheating forgery. Suicide thread related etc.; • Customer care/support Team in responding customer communications which are leading to probable litigation; • RBI Escalation Team in responding grievance referred to RBI by Customers; • Credit Ops Team to recovery wrongly disbursed amount from the customers/third party; • Business Teams to recover outstanding amount from dealers; • Finance Team to recover GST amount from vendors; • HR Exit Support Team to recover unpaid dues from ex-employees. Vetting & Drafting: • Replies to Legal Notices (including notices to directors / promoters/ SMT); • Replies to notices received from Law Enforcement Agencies Statutory / Regulatory Bodies etc.; • Escalation to various social media grievance redressal platforms; • Escalation to Government Ministries on a case to case basis; • Written statements counters affidavits various petitions/applications etc. • Police Complaints. Coordination with cross functional teams: To coordinate discuss & escalate wherever necessary in connection with varied notices received from customer their Lawyers Statutory authorities Judicial authorities & Quasi Judicial authorities. General: • To opine advise & define strategies in litigation and to achieve the desired outcome in favour of the Company. • To minimize the litigation and mitigate the legal and reputation risks. • Liasoning & coordinating with Advocates • Require travelling at least one regional legal officer’s location (outside of Pune) in every two months. • Take proactive initiative to control expenses to ensure fees are paid to the advocates reasonable and as per the approved matrix. • To ensure accuracy in maintaining and reporting all types of litigation. • As a Team Leader to efficiently manage the litigation team expectations. • To guide the team on varied litigation related matters. * Duties and Responsibilities - MAJOR CHALLENGES (Challenges faced on an on-going basis in carrying out the job) • Time management: In order to effectively handle higher volumes of litigation and other legal issues efficient time management is critical & indispensable. • Challenging Status quo/Create a common understanding of a situation: To get all the team members aligned around a common approach considering the varied local practices in courts. • Optimal utilization of resources: To ensure op...
