Job description
- Preparation/review of Title Search Reports (“TSR”), effectively and commercially addressing the observations mentioned in Draft Title Search Report and finalization of the TSR with counsels effectively with the intent to avoid any future claim or dispute over land.
- Drafting and vetting of the agreement to sell, sale deed, lease deed, land Aggregator agreement, NOC, POA etc. Assisting in registration/mutation of land and property documents;
- Experience in handling (i) institution of suits and defend cases filed against Company both under Civil and Criminal laws pertaining to land acquisition in any forum including drafting and review of pleadings including applications under Civil Procedure Code 1+08 and other land related laws, written statement, affidavit in evidence, written submissions; (ii) maintain records and undertake preparing and providing regular land cases/issues updates (iii) should have sound knowledge of Civil Procedure code, 1+08, Specific Relief Act, 1+63, Transfer of Property Act, 1882; Indian Succession Act, 1+25; Indian Easement Act, 1882 etc.
- Experienced in identification of lawyers and other consultants, as may be required, PAN India for (a) reviewing the land record, (b) obtaining and vetting the TSR and coordinating with them for the complete land procurement process; (c) for effectively representing the Company before competent authority/court regarding the legal cases instituted by or against the Company.
- Advising and updating the management with regulatory and legal changes applicable to Property & Real Estate Business in India.
- Supporting mortgage or security creation exercise for the deb finances obtained by the company
- MIS preparation and maintenance.
