Job Description

Our client, a leading high-rise developer is offering this new Legal Counsel position to a driven individual that can excel their legal experience in the property development space. This role is pivotal in supporting key stakeholders, including senior management and executives, in navigating complex legal landscapes and driving strategic initiatives forward.


Key Responsibilities:

Contractual Experience: Review, draft, and negotiate a wide array of legal and commercial agreements, emphasising construction, development, realty, and property-related matters. This includes retail and commercial leasing, acquisitions, disposals, and licensing.

Strata and Property Law: Evaluate contracts for sale, strata by-laws, and other relevant strata documents to ensure compliance and mitigate risks.

Litigation Management: Manage litigation strategies, coordinate with senior in-house & external counsel, and represent the company in court and tribunal settings.

Corporate Compliance: Assist with corporate governance, maintain corporate registers, and develop compliance policies and procedures.

Stakeholder Relations: Build and maintain strong relationships with internal and external parties, including employees, financiers, JV partners, regulators, and external counsel.

Statutory Compliance: Oversee ongoing statutory compliance requirements such as Safe Work, Fair Trading, and Fair Work regulations.

Legislative Knowledge: Advise on the business implications of legislation, including the D&BP Act, RAB Act, SOP Act, and other relevant laws.

Risk Assessment: Ensure all legal documentation reflects appropriate risk profiles and manage agreements between internal entities and third parties.

Negotiation Oversight: Manage day-to-day negotiations and amendments to standard documentation with subcontractors and consultants.

Dispute Resolution: Oversee and resolve disputes with third parties, including post-completion issues, ensuring timely and effective resolutions.

Project Interface: Collaborate with project teams to anticipate and resolve commercial and contract related issues and disputes.

Post-Completion Management: Address and manage post-completion issues associated with business operations effectively.

Qualifications and Experience:

Law degree with current Australian practicing certificate.
Over 4 years PQE in construction, property, corporate law & litigation.
Construction and Planning & Environment litigation experience preferred.
Proven ability to liaise with senior management.
Strong drafting and communication skills.
Exceptional multitasking and stakeholder management.
Excellent time management, and critical thinking skills.
Team player with autonomous problem-solving skills.
