Responsibilities will include
1. Functional Expertise
• Product structuring related fintech lending products
- The primary responsibility is to provide legal advice and support to the business/product on a broad range of legal issues pertaining lending products (especially digital lending products) such as business loans, personal loans, BNPL. This include ensuring the product complies regulatory framework
• Review & Negotiate contracts with LSP partners:
Will be drafting, reviewing, and negotiating MSA with the Lending Service Provider/DSA/DMA partners such as fintech and other vendors providing technology solutions such digital KYC solutions, digital signing etc.
• Standardizing of loan documents & process
- Standardizing loan documents (such as loan agreement, KFS, Sanction Letters, application forms etc) for various corporate & retain loan product such as personal loans, business loans, secured loans etc. and build processes for effective management of the legal function
• Treasury:
Creating, negotiating and executing fund raise documents such term loans, credit lines, overdraft, bank guarantee for fund raise by the NBFC from banks/NBFC/VC funds. Manage all formalities for execution of documentation and archival of documents properly.
• Litigation Management
- o Managed the recovery litigation (Arbitration, S.138/25
- Cheque/NACH bounce, recovery suits (O.37 suits) against defaulting borrower , administering and have responsibility for litigation strategy and policy.
o Manage External Counsel:
Will manage external counsel to ensure efficient and effective legal
support for the business. This includes identifying external legal resources when necessary and
managing relationships with external counsel.
2. Problem Solving
• Solve of business issues related to recovery of loans
• Ensure proper compliance paperwork is in place & solve for pending issues
• Establish clean processes for recovery with positive brand image
3. Interaction:
• Both internal and external stakeholders and law enforcement agencies
• Collaborate with cross-functional teams, including product, engineering, compliance, and finance, to ensure legal compliance and manage legal risks. They must understand the business needs and provide practical legal solutions that meet those needs.
• Must monitor and keep abreast of changes in laws and regulations related to fintech and NBFC sector. They must advise the business accordingly and ensure that the company remains compliant with these changes.
• Manage external counsel to ensure efficient and effective legal support for the business. This includes identifying external legal resources when necessary and managing relationships with external counsel.
• Managing tracker and other MIS maintained by the Legal team, perform internal checks/review of processes & highlight issues along with resolutions.
Qualification & Experience
● LLB degree.
● 7-11 years of experience in a similar role
