Agueci Calabretta, colloquially known as AC Law, is a boutique law firm focused on debtor/creditor law with an emphasis on mortgage enforcement and real estate transactions for financial institutions. Working with lawyers and law clerks, our team is well equipped to address any real estate matters, from simple closings of purchases, sales, mortgages, and refinances, to acting on behalf of institutional mortgage and private lenders.
What We Are Looking For:
We are seeking an experienced litigation lawyer with 8+ years of experience to complement our mortgage enforcement practice. The successful candidate will manage complex power of sale proceedings and other associated matters, while providing strategic counsel to both private and financial institution clients. The candidate will also be responsible for reviewing materials for court proceedings; and oversee a high-volume caseload from initiation through to final disposition while supervising junior lawyers. Preference will be given to lawyers who have mortgage enforcement experience.
Responsibilities:
Conduct all property and execution searches required for the preparation of the Notice of Sale Under Mortgage and Notice of Intention to Enforce Security;
Request, obtain and review all mortgage related documents; including discharge statements, Standard Charge Terms; mortgage commitments; etc…
Preparation of all related documents for the Notice of Sale Under Mortgage; Notice of Assignment of Mortgage; and, Notice of Intention to Enforce Security;
Review title searches and oversee off-title searches;
Attend to making copies and serving appropriate notice documents in accordance with the Mortgages Act;
Deal directly with clients, financial institutions, municipalities, land registry offices and title insurance companies
Assist generally with all matters relating to our real estate practice
Requirements:
Good standing with the Law Society of Ontario
Minimum 5-7 years previous experience as a Lawyer
Knowledge of mortgage enforcement and power of sale (preferred)
