Major Responsibilities:

To provide the following Prosecutor 1 services:
Represents the City of Toronto in the Ontario Court of Justice in an advocacy role on charges initiated by the Ontario Provincial Police, the Toronto Police Service, inspectors, investigators and City enforcement staff for violations of various statutes and by-laws.
Appears at crown pretrial and judicial pretrial meetings, negotiates resolutions with opposing counsel, agents and members of the public while ensuring adherence to city, divisional and other applicable policy.
Composes and analyzes technical legal documents and correspondence, including but not limited to Evidence Act Notices, disclosure materials, Notices of Motion, Affidavits, Summonses, Factums, Search Warrants, reports, written submissions, opinions on issues of law, Closure Orders, Prohibition Orders, Destruction Orders and Interim Custody Orders.
Researches and analyzes case law using legal tools and resources available to determine appropriate course of action and to assess sufficiency of evidence at trial and make recommendations to City and enforcement staff.
Conducts research, analysis and interpretation of statutes and regulations as required for the evaluation of evidence in the preparation for trial. Keeps apprised of developing case law and amendments to statutes, legislation, and the municipal bylaws.
Represents the City of Toronto in the Ontario Court of Justice in trials, appeals, and motions including motions under the Canadian Charter of Rights and Freedoms.
Assesses case files, determines the reasonable prospect of conviction, prosecutes cases in court, tenders evidence, examines and cross-examines witnesses, presents oral and written arguments, summarizes evidence and makes submissions regarding recommendations for judgment and sentencing.
Coordinates and meets with the Ontario Provincial Police, the Toronto Police Service, inspectors, investigators, enforcement staff, civilian and expert witnesses to prepare for their appearance in the Ontario Court of Justice.
Prepares and analyzes current internal and external training materials for City enforcement staff to assist in their gathering of evidence.
Advise enforcement staff on prosecutorial related issues. Conducts educational seminars for all relevant enforcement staff to ensure sufficiency of evidence to support charges, preparation of documentary evidence, proper conduct in court, understanding of trial procedure and preparedness for cross-examination.
Provides advice and guidance to police, enforcement staff, members of the legal profession, City of Toronto officials, member of the public, and administrative staff based on knowledge of the requirements and procedures under the Provincial Offences Act, Rules of Court, and other applicable legislation.
Prepares correspondence to client departments including case dispositions and enforcements reports.
Initiates, conducts and responds to appeals before Judges in the Ontario Court of Justice, Appeal level, including the research and preparation of oral and written legal arguments.
Attends neighbouring jurisdictions to prosecute as required
Performs screening of administrative penalties for the City of Toronto and attends hearings before the Administrative Penalty Tribunal
Key Qualifications:

Your application must describe your qualifications as they relate to:

Must possess a valid license from the Law Society of Ontario as a lawyer or paralegal
Considerable experience in prosecuting or defending charges under the Highway Traffic Act, Provincial Offences Act, and other Provincial Statutes
Experience in prosecuting or defending charges under municipal by-laws as well as arguing appeals in the Ontario Court of Justice under the Provincial Offences Act and other Provincial Statutes

You must also have:
Thorough knowledge of the Provincial Offences Act
Knowledge of applicable legal practices and procedures in the Ontario Court of Justice
Extensive knowledge of relevant legislation
Highly developed written and oral communication skills, ability to prepare correspondence and legal documentation using Microsoft Office Suite and other systems as applicable
Ability to maintain a high level of confidentiality
Ability to deal courteously, tactfully and ethically with the public and staff and provide a high level of customer service
Ability to work both independently and as part of a team
Skills of advocacy; good judgement and analytical skills to assess case evidence, determine whether not to prosecute, and to determine how to proceed with cases in court
Must be willing to work out of various POA Court locations and work remotely when necessary
